These Terms of Service ("Terms") govern your use of the 57messages mobile application and related services. By creating an account, selecting an option that indicates acceptance, or otherwise using 57messages, you acknowledge that you have read and agree to these Terms and our Privacy Policy.
1. Acceptance and Eligibility
You must be legally able to agree to these Terms. If you are under the age of legal majority where you live, you may use 57messages only with permission and supervision from a parent or legal guardian. If you use 57messages for an organization, you represent that you have authority to bind that organization.
2. The 57messages Service
57messages is an instant messaging service for one-to-one and group conversations. It supports text, image, and video messages. It does not currently provide voice calls, video calls, or location-sharing features.
We may add, change, limit, suspend, or discontinue features when reasonably necessary for maintenance, security, legal compliance, or service development. We do not guarantee that every feature will always be available on every device or in every location.
3. Your Account
- Provide accurate information and keep it reasonably up to date.
- Use a username, profile image, and profile information that are lawful, accurate, and do not impersonate another person or infringe another party’s rights.
- Keep passwords, verification codes, and devices secure.
- Do not sell, rent, lend, or transfer your account.
- Tell us promptly at support@82.nz if you believe your account has been compromised.
You are responsible for activity under your account to the extent permitted by law.
4. User Content
You retain ownership of text, images, videos, and other content you submit through 57messages ("User Content"). You are responsible for your User Content and must have the rights needed to share it.
You grant 57messages a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, and display your User Content only as necessary to operate, secure, and improve the service. This license ends when the content is deleted from our systems, subject to reasonable technical and legal retention periods.
5. Acceptable Use
You may not use 57messages to:
- Break the law or encourage unlawful activity.
- Infringe intellectual property, privacy, publicity, or other rights.
- Harass, threaten, exploit, impersonate, defraud, or harm another person.
- Share child sexual abuse material, non-consensual intimate content, hateful content, credible threats, or content that promotes violence.
- Send spam, scams, malware, or unauthorized commercial messages.
- Probe, disrupt, reverse engineer, overload, or bypass security or access controls, except where such restriction is prohibited by law.
- Scrape data or use automated systems to access 57messages without our written permission.
6. Safety, Reports, and Enforcement
57messages includes tools to block users and report accounts or content. We may investigate reports and, when reasonably necessary, remove content, limit features, suspend or terminate accounts, preserve evidence, or report activity to appropriate authorities. Enforcement decisions may consider context, severity, repetition, risk, and applicable law.
If you face an immediate threat or emergency, contact local emergency services. 57messages is not an emergency service.
7. Fees and Third-Party Charges
Unless clearly stated otherwise, 57messages is currently provided without an application subscription fee. We may introduce paid features in the future, but we will disclose applicable prices and obtain any required agreement before charging you. You remain responsible for internet access, mobile data, SMS, device, App Store, and other third-party charges associated with your use of the service.
8. Third-Party Services
57messages relies on service providers, including cloud messaging infrastructure, to operate. Your use of third-party services may also be subject to their terms and policies. We are not responsible for third-party products or services that we do not control.
9. Our Intellectual Property
57messages, including its software, interface, design, name, logo, code, and documentation, is owned by the 57messages Team or its licensors and is protected by applicable laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use 57messages for its intended purpose. Except where applicable law permits otherwise, you may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the service.
10. Suspension, Termination, and Account Deletion
You may stop using 57messages at any time. You may request account deletion by emailing support@82.nz from the address associated with your account.
We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or legal exposure, or if suspension is reasonably necessary to protect 57messages or its users. Where appropriate, we will provide notice. Sections that by their nature should survive termination will remain in effect.
11. Availability and Events Beyond Our Control
The service may be interrupted, delayed, changed, or unavailable because of maintenance, network or equipment failure, third-party service failure, power outage, government action, natural disaster, labor dispute, cyberattack, or another event beyond our reasonable control. We will use reasonable efforts to maintain the service, but we are not responsible for failures caused by events we cannot reasonably control.
12. Disclaimers
To the maximum extent permitted by law, 57messages is provided “as is” and “as available.” We do not make warranties that the service will be uninterrupted, error-free, secure, accurate, reliable, or suitable for every purpose. You are responsible for evaluating information and interactions you encounter through the service. Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.
13. Limitation of Liability
To the maximum extent permitted by applicable law, the 57messages Team will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, goodwill, or business opportunity arising from your use of 57messages. This limitation does not apply where liability cannot legally be limited.
14. Responsibility for Claims
To the extent permitted by law, if your unlawful User Content, misuse of the service, or material violation of these Terms causes a third-party claim against the 57messages Team, you agree to be responsible for the resulting losses and reasonable costs. This obligation does not apply to the extent a claim results from our own unlawful conduct, negligence, or breach of these Terms.
15. Apple App Store Terms
If you download 57messages through Apple’s App Store, these Terms are between you and the 57messages Team, not Apple. Apple is not responsible for 57messages or its support. Your license is limited to use on Apple-branded products you own or control as permitted by the App Store Usage Rules. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce this section.
16. Notices
We may provide service-related notices through the app, by email, on this website, or by another reasonable electronic method. Notices you send to us should be directed to support@82.nz. You are responsible for keeping your account contact information current.
17. Changes to These Terms
We may update these Terms to reflect changes to 57messages, our practices, or applicable law. We will post updated Terms and revise the effective date. If a change is material, we will provide additional notice where required. Your continued use after the updated Terms take effect constitutes acceptance where permitted by law.
18. General
These Terms and our Privacy Policy form the agreement between you and the 57messages Team regarding 57messages. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. We may transfer these Terms as part of a merger, reorganization, financing, acquisition, or sale of assets, subject to applicable law and appropriate notice. These Terms are governed by applicable law, without limiting any mandatory consumer rights available where you live.
